A meeting of the West Lampeter Township Zoning Hearing Board was held on June 12, 2012 at 7:00 p.m. in the township building at 852 Village Road in Lancaster County, PA. Members present were John Howard and Rebecca Denlinger. Also present were Zoning Officer Joellyn Warren, Court Reporter Raymond and Recording Secretary LeVon Burgess.

 

Minutes Approval Minutes of the previous meeting of June 7, 2012 were not approved due to the fact that only one board member present tonight was present at the June 7, 2012 meeting. Minutes will be approved at a future meeting.

 

MICHAEL AND TERRY BAKER – VARIANCE

 

Applicant is proposing to rent an existing detached building and is requesting a Variance from Section 285-43 D (20), (a), (e) of the West Lampeter Township Zoning Ordinance.

Joellyn Warren presented proof of publication and posting of the property at 1023 Gypsy Hill Road. Mrs. Warren also presented testimony on the property regarding certificate of occupancy and zoning of the property.

 

Mr. Baker presented evidence and testimony explaining that they would like to turn the garage structure into a residence rental.

 

The Board heard closing summaries and announced that they would go into executive session. Upon returning the record was closed and the Board announced that they would render a decision on July 10th, 2012.

 

JOHN STOLTZFUS – VARIANCE

 

Applicant is proposing an addition to an existing dwelling and is requesting a Variance from Section 285-35 E (2) (a) of the West Lampeter Township Zoning Ordinance.

Joellyn Warren presented proof of publication and posting of the property at 757 Strasburg Pike.

 

The Board heard evidence and testimony from applicant John Stoltzfus and Samuel Fisher, representative from Beaver Creek Construction.

 

Mrs. Warren presented testimony. The Board and Mrs. Warren had questions for the John Stoltzfus and Samuel Fisher.

 

The Board closed the record and rendered the following decision:

 

Based upon the Application and testimony, the Zoning Hearing Board of West Lampeter Township hereby grants approval of the application of John Stoltzfus for property located at 747 Strasburg Pike, Strasburg, PA for a 14-foot variance from the 50-foot front yard setback requirement.  Motion carried 2-0.

 

 

Meeting Adjourned at 8:05 p.m.
